Terms of Service

These Terms of Service (“Terms”) govern access to and use of harvestwave.com and HarvestWave, LLC’s business phone-number identification service, including the marketing site, customer portal, and API (together, the “Service”).

By creating an account, purchasing credits, calling the API, or otherwise using the Service, you agree to these Terms on behalf of yourself and the business you represent (“Customer,” “you”).

1. The Service

HarvestWave provides a B2B identification service. You submit a phone number; we return whether that number is associated with a business and which firm or firms are listed on it.

  • Matches are exact. There is no fuzzy matching. An off-by-one digit is a different number.
  • Response shape and available fields are as documented for implementers (including whether the number is a business and listed firm names/confidence). Extra fields appear only when your account is entitled to them and they exist on the record.
  • The Service is offered for call centers and related systems that need to know when a number is a business acting on behalf of a customer rather than a customer’s direct line.

We do not invent uptime percentages, compliance certifications, or product claims beyond what we publish.


2. Accounts and access

  • Portal credentials are for human users (billing, credentials, account administration).
  • Applications call the API with an API key or an OAuth2 client-credentials token.
  • You are responsible for safeguarding credentials, for all activity under your account, and for ensuring your users and apps comply with these Terms.
  • You must be a business or acting for a business. The Service is not for consumer personal use.

3. Credits and fees

  • The Service is sold as prepaid credits. 1 credit = $0.01 (USD).
  • A lookup that returns a business (isBusiness true) spends one credit.
  • Misses are free.
  • Entitled extra data slices that appear on the response spend one credit each when returned.
  • Credits are prepaid and non-refundable except where required by law or where HarvestWave agrees in writing. Unused credits remain on the account until used or the account is closed under these Terms.
  • Payment is processed by Stripe (or another processor we name later). You authorize charges for credit purchases you initiate.

Taxes: Fees are exclusive of taxes. HarvestWave treats the Service as a service offering. Customer remains responsible for taxes imposed on Customer other than taxes based on HarvestWave’s net income.


4. Acceptable use

You will use the Service only for lawful internal business purposes consistent with documentation.

You will not:

  • Use the Service for unlawful surveillance, stalking, harassment, fraud, or other illegal activity
  • Attempt to reverse engineer, overload, or disrupt the Service
  • Share credentials to evade account or credit rules
  • Resell raw Service access without HarvestWave’s written permission
  • Submit phone numbers you are not authorized to look up in connection with your legitimate business operations

You are solely responsible for your compliance with telemarketing, consumer-protection, privacy, and other laws that apply to your use of lookup results. HarvestWave provides identification software; we do not give legal advice about how you use a result in your call center or other systems.


5. Customer data and confidentiality

  • You retain rights in the phone numbers and account content you submit.
  • You grant HarvestWave a limited license to process that data to provide, secure, bill, and improve the Service.
  • HarvestWave will not disclose your account data or lookup payloads to third parties except (a) to processors needed to run the Service (such as Stripe), (b) to your authorized users/apps, or (c) when presented with a search warrant or other binding legal process, and then only information responsive to the scope of that process. HarvestWave will not perform a blank whole-account turnover.
  • Our Privacy Policy (https://www.harvestwave.com/privacy/) explains personal-information practices in more detail, including lookup-log retention (90–180 days) and hashing of phone numbers in those logs.

6. Intellectual property

HarvestWave and its licensors own the Service, documentation, software, trademarks, and all improvements. No rights are granted except the limited right to use the Service under these Terms. You may not copy, scrape for competing dataset construction, or create derivative works of the Service except as allowed by law or written agreement.


7. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, HARVESTWAVE DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT LOOKUPS WILL BE ERROR-FREE, COMPLETE, OR UNINTERRUPTED, OR THAT RESULTS WILL MEET YOUR PARTICULAR ROUTING OR COMPLIANCE NEEDS.

Identification results reflect available business-association data for an exact phone number. Numbers change ownership; records can be incomplete. You are responsible for how you rely on a result.


8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HARVESTWAVE’S TOTAL LIABILITY ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO HARVESTWAVE FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM. HARVESTWAVE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS, EVEN IF ADVISED OF THE POSSIBILITY.

Nothing in these Terms limits liability that cannot be limited under applicable law.


9. Indemnity

You will defend and indemnify HarvestWave against third-party claims arising from your use of the Service, your lookup submissions, your handling of results, or your violation of these Terms or law, except to the extent caused by HarvestWave’s willful misconduct.


10. Suspension and termination

We may suspend or terminate access for non-payment, abuse, legal risk, or material breach. You may stop using the Service at any time. On closure, your right to access ends; sections that should survive (fees owed, IP, disclaimers, liability limits, indemnity, governing law) survive.


11. Governing law; disputes

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-laws rules. Exclusive venue for disputes is the state courts in Teller County, Colorado, unless the parties agree in writing to arbitration.


12. Changes

We may update these Terms by posting a revised version on this site. The effective date will change when we do. Material changes apply going forward. Continued use after an update constitutes acceptance.
